Per se tort意思

"Per se tort" is a legal term that means "tort in and of itself." In the context of law, a tort is a civil wrong that results in harm to someone else, for which the injured person may seek compensation from the person who caused the harm. A per se tort is a type of tort that is automatically considered to be a wrongful act, without the need for any additional proof of negligence or intent to harm.

For example, in many jurisdictions, certain acts are considered per se torts, such as battery (unlawful physical contact), trespass to land (entering someone's property without permission), and conversion (wrongfully taking someone's personal property). In these cases, the act itself is enough to establish liability, regardless of the intentions of the person committing the act.

In contrast, not all torts are per se. Some torts require proof of negligence or other factors in addition to the act itself. For example, in a negligence case, the plaintiff must prove that the defendant had a duty of care, breached that duty, and that the breach caused the plaintiff's injuries.
